Conditions of
Entry
- Copyright and Related Matters - You are responsible for all of the images uploaded
or sent using this site. You must have the legal right to display each image
that you upload or mail for the purpose of the "Application of the
Month" contest. All images must be uploaded or mailed with the
knowledge and consent of the owners of the facility
in which the image was taken.
If the photos you are submitting were taken
in someone elses facility, a written release must be obtained that gives
you permission to use the photos ( click here for an example media release form
). By uploading or mailing an image, you certify to Gorbel
that you have the legal right to upload each image for use by Gorbel and
grant to Gorbel a non-exclusive, royalty- free license to use, copy,
display, reproduce, distribute, and publish, in its sole discretion, all
or part of those images in media. The exhibition assumes no
liability for any misuse of copyright by the entrant.
- The
exhibition is open to anyone; however, an entry may be rejected when the
sponsoring organization or its agent, in its reasonable discretion,
believes the entry does not conform to exhibition rules and conditions.
- Prints
uploaded should be in .gif or .jpg format and should be no larger than 400 pixels square. Photographs
which have been mailed will not be returned. You are
solely responsible for creating backp-ups of your images uploaded or mailed to Gorbel
for the contest and Gorbel has no obligation to display,
preserve, or return any images submitted.
As a condition
of participation in the Gorbel "Application of the Month" contest and use of this site, you shall
not:
- Forge or
otherwise manipulated identifiers in order to disguise the origin of any
content submitted through this site.
- Upload,
email, or otherwise transmit any material that contains software viruses
or other such form designed to disrupt, destroy, or limit the
functionality of any computer software.
- Provide any information that is false or misleading,
that attempts to hide your identity or that you do not have the right to
disclose.
- Harm minors in any way, including
but not limited to any image that violates federal and state pornography
laws or other laws protecting children from sexual
exploitation.
DISCLAIMER OF WARRANTY AND LIMITATIONS OF
LIABILITY
YOU, AS A CONTEST ENTRANT, UNDERSTAND AND AGREE
THAT THE SUBMISSION OF ANY DIGITAL IMAGE, FILM OR PHOTOGRAPH AND/OR THE
UPLOAD OF ANY MATERIAL TO THIS SITE IN CONNECTION WITH THE GORBEL
“APPLICATION OF THE MONTH” CONTEST IS DONE AT YOUR OWN DISCRETION AND RISK
AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY AND ALL CLAIMS BY ANY
THIRD PARTY OR PARTIES FOR INFRINGEMENT OF ANY COPYRIGHT, TRADEMARK OR
MASK WORK OR FOR ANY VIOLATION OF ANY TRADE SECRET OR OTHER PROPRIETARY
INTELLECTUAL PROPERTY RIGHTS BY VIRTUE OF THE USE, DISPLAY AND/OR
PUBLICATION OF ANY DIGITAL IMAGE, FILM OR PHOTOGRAPH THAT YOU UPLOADED,
MAILED OR OTHERWISE TRANSMITTED TO GORBEL AND YOU FURTHER UNDERSTAND AND AGREE
THAT YOU ARE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE TO YOUR FILM,
PHOTOGRAPH OR DIGITAL IMAGE AND FOR ANY LOSS OF DATA OR DAMAGE TO YOUR
COMPUTER SYSTEM THAT MAY RESULT THEREFROM. THIS SITE AND THE SERVICES
PROVIDED BY GORBELPURSUANT TO THIS GORBEL “APPLICATION OF THE MONTH”
CONTEST, INCLUDING GRANTING TO YOU THE RIGHT TO PARTICIPATE IN THIS
CONTEST, ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES WHATSOEVER, EXPRESS
OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT,
ALL OF WHICH ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PROVIDED BY
LAW. GORBEL EXPRESSLY
DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS AND
PERFORMANCE OF THIS SITE AND/OR THIS CONTEST.
